The Regulation Amending the Regulation on the Fees to be Charged under the Law No. 1567 on the Protection of the Value of Turkish Currency (“Amending Regulation”) has been published in the Official Gazette dated 23.02.2023 and numbered 32113.
The definition of “Refinery” has been added to the first paragraph of Article 3 of the Regulation on Fees to be Charged within the Scope of the Law No. 1567 on the Protection of the Value of Turkish Currency (“Regulation”) with the Amending Regulation.
Accordingly, Refinery refers to the refineries whose procedures and principles regarding establishment, activities, obligations and audits are regulated in the Communiqué on Precious Metals Standards and Refineries (Communiqué No: 2023/1) published in the Official Gazette dated 23 February 2023 and numbered 32113.
Furthermore, article 4/A has been added to the Regulation with the Amending Regulation stipulating that a fee of 8.000.000 Turkish liras will be charged for the applications of refineries for operating licences.
In addition, it is stated that this amount shall be increased each year by the revaluation rate determined and announced in accordance with the provisions of the repeated Article 298 of the Tax Procedure Law dated 4/1/1961 and numbered 213 for the previous year, effective from the beginning of the calendar year.
The Amending Regulation has entered into force on the date of publication.
