The Communiqué on Commercial Electronic Message Management System Integrators (“Communiqué”) regulates the procedures and principles regarding the recording of commercial electronic message approval and rejection information in the Message Management System (“IYS”), the realization of these transactions through the IYS through integrators or by service providers, the authorization of integrators and the revocation of their authorization. On 08.04.2025, with the amendments published in the Official Gazette and entered into force, it has been amended that the applications of service providers who wish to obtain an integrator authorization shall be carried out by the organization authorized by the Ministry to establish the Commercial Electronic Message Management System (“Organization”) in accordance with Article 9 of the Communiqué. With this amendment, the application procedures will be carried out according to the following procedures in accordance with Article 9 of the Communiqué.
Article 9- (1) The integrator is obliged to avoid transactions that may jeopardize the security of the IYS and/or damage the IYS in the provision of the integrator service, to establish the necessary network and system security against unauthorized access and cyber-attacks, to have minimum backup and disaster recovery plans, to keep records of all transactions, and to take other administrative and technical measures stipulated in the contract with the Organization.
(2) The Ministry is authorized to determine additional obligations other than those stipulated in the first paragraph and to impose the obligation to comply with national and international standards.
Prior to the aforementioned amendment, it was regulated that those who did not obtain an integrator authorization from the Ministry until the end of the sixth month following 18.09.2024, the date the Communiqué entered into force, could not establish any transaction regarding commercial electronic messages on behalf of the service provider and could not perform any transaction through IYS. With the amendment in question, it has been decided that the period determined for obtaining integrator authorization can be extended up to three months by the Ministry.
